摘　　要：十年前,法教义学在民法领域刚刚风行,民法典编纂及配套工作旋即成为民法学界的工作重心。此后,两条线索互相影响,中国民法教义学初具规模。整体和平均来看,民法学研究在案例使用、与社会科学融合方面有长足进步,但在比较法运用、学术规范方面仍有不足。从违约方解除权及合同僵局、担保人法定内部追偿权、夫妻财产的物权变动模式、比例原则在民法中的适用这四项重大论争来看,中国民法学在集体智慧层面已经具备极高的法教义学和价值判断工作能力;但是,重复劳动较多,也未形成良好的学术积累和传承机制。民法学的未来发展,取决于研究目标设定、议题选取、方法应用以及对合作作品、学术会议、法学文献功能定位等不同学术分工合作模式的重视。Ten years ago,legal dogmatics in the field of civil law were just beginning to emerge,while the codification of the Civil Code and related work soon became the main focus of the civil law academic community.Since then,these two threads have influenced each other,gradually promoting the development of Chinese civil law dogmatics.Overall,civil law scholarship has made significant progress in case application and integration with social sciences;however,there are still deficiencies in the use of comparative law and adherence to academic norms.From the four major debates on the termination right of the breaching party,the statutory right of internal recourse for security providers,the rules of property rights alteration in marital property,and the application of the proportionality principle in civil law,it can be seen that Chinese civil law scholarship possesses a high level of doctrinal and value judgment capabilities at the collective intellectual level.However,there is also a significant amount of repetitive research,and an effective mechanism for academic accumulation and transmission has yet to be established.The future development of civil law scholarship will hinge on the establishment of research objectives,the selection of topics,the application of methodologies,and the appreciation of diverse modes of academic collaboration,such as joint publications,academic conferences,and the functional classification of various forms of legal literature.
