摘　　要：随着互联网和大数据的不断发展,信息处理者违法收集和处理敏感个人信息的事件频发。鉴于敏感个人信息存在特殊性,对其滥用或者非法使用所引发的损害程度远甚于一般个人信息,需要采取更为严格的法律保障措施对其进行特殊保护。对此,我国《个人信息保护法》首次针对敏感个人信息做出了有关规定,但仍存在法律界定模式不够清晰等问题。因此,可以通过引入“场景理论”完善敏感个人信息的界定逻辑,明确处理敏感个人信息的前提,同时基于“告知-同意”规则确保信息主体在充分知情下自愿做出决定。上述建议不仅有助于全面加强对敏感个人信息的法律保护,更对完善我国个人信息保护法律体系和建设法治信息社会具有积极促进作用。With the continuous development of the Internet and big data,there have been frequent incidents of information processors collecting and handling sensitive personal information in violation of the law.In view of the special nature of sensitive personal information,the damage caused by its misuse or illegal use is far greater.than that of general personal information,so it is necessary to adopt more stringent legal safeguards to provide special protection for it.In this regard,China's Personal Information Protection Law has for the first time made relevant provisions for sensitive personal information,but there are still problems such as the lack of a clear legal definition model.Therefore,the logic of defining sensitive personal information can be improved by introducing the "scenario theory",clarifying the premise of handling sensitive personal information,and at the same time,ensuring that the information subject makes a voluntary decision based on the "notification-consent" rule with full knowledge.The above suggestions will not only help to comprehensively strengthen the legal protection of sensitive personal information,but will also have a positive effect on the improvement of the legal system for the protection of personal information and the construction of an information society based on the rule of law in China.
