摘　　要：《中华人民共和国海上交通安全法》明确规定“船长负责管理和指挥船舶。在保障海上生命安全、船舶保安和防治船舶污染方面,船长有权独立作出决定。”在该法的释义中首次提出“船长作为船上的最高指挥者,是船舶安全生产的第一责任人”,这是法律赋予船长在船舶管理上的权利。如何牢牢抓住船长作为船舶安全生产“第一责任人”这个核心岗位,落实航运企业安全生产主体责任,是解决水上交通本质安全的关键。According to the new Maritime Traffic Safety Law of the People's Republic of China,"the captain shall be responsible for the management and command of the vessel.The captain has the discretion to make independent decisions concerning the safety of life at sea,the security of the vessel,and the prevention and control of pollution caused by the vessel."In the interpretations of the the law,it has been clarified for the first time that"the captain,as the highest commander on board,is the principal person responsible for ship's safe operation",which is a right entrusted to the captain in ship management by the law.It is crucial for ensuring the essential safety of maritime traffic to seize the core role of the captain as the principal person responsible for ship's safe operation and implement the main responsibility of shipping companies for safe operation.
