摘　　要：船舶载运危险货物谎报瞒报行为一直是海事监管的重点难题,在最新修订的相关法律已正式施行的背景下,基于基层海事危险货物现场监管工作,通过对2019年以来全国危险货物集装箱海运谎报瞒报违法行为处罚案例的分析,列明我国危险货物集装箱海运谎报瞒报违法行为的种类,剖析其在违法行为定性以及处罚依据的法律适用方面存在的问题和歧义,并就厘清法律法规适用范围以及更好地履行国际公约提出相关建议。The issue of false and concealed declaration of dangerous goods onboard vessels has always been a significant challenge in maritime supervision.Under the background that relevant laws of new revisions have been officially implemented,this paper focuses on the on-site supervision of maritime dangerous goods by grass-roots maritime administrations and analyzes the administrative punishment cases involving illegal practices of false and concealed declaration of dangerous goods onboard vessels in China since 2019.It identifies the categories of of such violations,analyzes the problems and ambiguities surrounding the characterization of violations and the law application concerning administrative punishment,and proposes relevant suggestions to clarify the scope of law enforcement and enhance compliance with international conventions.
