海员外派机构法律属性与外派海员权益保障机制研究

摘　　要：航运业长期低位运行,导致我国海员在境外因欠薪等原因主张遣返权利的事件时有发生。结合青岛海事法院对“R”轮欠薪案的判决,围绕海员外派机构在派遣海员过程中的权利和义务,分析海员外派机构的相关法律地位和属性,提出完善海员派遣制度的建议。The prolonged downturn in the shipping industry has resulted in recurrent incidents where Chinese seafarers abroad are forced to claim their repatriation rights due to unpaid wages and other related issues.This paper,based on the rulings of the Qingdao Maritime Court in the case involving unpaid wage of"R"vessel,focuses on the rights and obligations of seafarer recruitment and placement services in the process of seafarer deployment,analyzes the legal status and attributes of such agencies,and offers recommendations for improving the seafarer dispatch system.
