摘　　要：不当联结禁止原则是行政法上的一项基本原则。不当联结禁止原则,具有深厚的历史逻辑,体现为株连制度的废弃和株连思想历史惯性的摆脱;具有科学的理论逻辑,体现为法治精神的要求与普遍正义的捍卫;具有鲜明的实践逻辑,体现为公共行政的多元手段必须予以厘清的要求。不当联结禁止原则由依法行政原则、比例原则以及平等原则推导而来,但是在行政法的基本原则群中,不当联结禁止原则依然具有独特价值,尤其是与意涵相近的法律保留原则、适当性原则和禁止恣意原则存在适用上的区分。在加快构建中国自主的行政法学知识体系的大背景下,不当联结禁止原则必须坚持守正创新,要进一步明确该原则的内涵和外延、细化不当联结的分类、明晰不当联结的判定以及规范不当联结的审查。The principle of prohibition of improper connection is a fundamental principle in administrative law.The principle of prohibition of improper connection has profound historical logic,which is embodied in the abandonment of the system of collective punishment and the breaking away from the historical inertia of the thought of collective punishment.It has scientific theoretical logic,which is embodied in the requirements of the spirit of the rule of law and the defense of universal justice.It has a distinct practical logic,which is reflected in the need to clarify the multiple instruments of public administration.The principle of prohibition of improper connection is derived from the principle of law-based administration,the principle of proportionality and the principle of equality.However,in the group of basic principles of administrative law,the principle of prohibition of improper connection still has its unique value,especially in terms of the distinction in the application between it and the principle of legal reservation,the principle of appropriateness and the principle of prohibition of arbitrariness,which all have similar meanings.In the context of accelerating the construction of China's independent knowledge system of administrative law,the principle of prohibition of improper connection must adhere to integrity and innovation,further clarify the connotation and extension of the principle,refine the classification of improper connection,clarify the determination of improper connection,and standardize the review of improper connection.
