摘　　要：国际海底管理局正在制定的《“区域”内矿产资源开发规章》(简称《开发规章》)是未来各国开展国际海底矿产资源开发的重要法律依据和规范,关系到相关活动的合法性和合规性。该文首先系统分析了《开发规章》的制定进程以及《开发规章》草案对承包者申请开发合同及开始商业开采的生产要求、缴费要求、环境要求和监管要求等主要制度性要求;然后分析了《开发规章》制定面临的形势及前景,并在此基础上研究了我国对于国际海底矿产资源从勘探迈入开发所需重点关注的问题;最后再结合我国深海矿产资源开发利益和诉求,就建设性参与《开发规章》制定提出对策建议。The“Regulations on Exploitation of Mineral Resources in the Area”(referred to as the“Exploitation Regulations”)being formulated by the International Seabed Authority serves as a critical legal basis and standard for future international seabed mineral resource exploitation activities by various countries,which is related to the legality and compliance of such activities.This study first systematically analyzes the formulation process of the“Exploitation Regulations”.The main institutional requirements set in the draft“Exploitation Regulation”for contractors applying for exploitation contracts and initiating commercial activities,such as production,payment,environment and regulatory requirements,are examined.Then,the current situation and prospects faced by the formulation of the“Exploitation Regulations”are analyzed.On this basis,the crucial issues that need to be considered from exploration to development of international seabed mineral resources are studied.Finally,suggestions for constructive participation in the formulation of the“Exploitation Regulations”are proposed based on the interests and demands of China's deep-sea mineral resource exploitation.
