摘　　要：探讨FTA数字贸易规则缔结质量对于中国深度参与区域性数字贸易合作的发展战略具有重要意义。基于2005—2021年187个涉及数字贸易规则的FTA和110个经济体的面板数据,实证检验了第三方效应对FTA数字贸易规则缔结质量的影响。研究发现:自主FTA效应之和能显著提升数字贸易规则的缔结质量,自主FTA效应之差显著抑制数字贸易规则的缔结质量。从分条款角度来看,数据管理条款、隐私保护条款、知识产权保护条款、争端解决与合作条款的缔结质量受第三方效应的影响;从国别角度来看,相对于“南—南”经济体,“北—北”经济体对自主FTA效应之差更为敏感;相比于“北—北”经济体,自主FTA效应之差的负面作用在“南—北”经济体之间更小。Discussing the quality of conclusion of FTA digital trade rules is of great significance to China's development strategy of deeply participating in regional digital trade cooperation.Based on panel data of 187 FTAs involving digital trade rules and 110 economies from2005 to 2021,this paper empirically tests the impact of the third party effect on the quality of conclusion of FTA digital trade rules.The study finds that the sum of autonomous FTA effects can significantly improve the quality of conclusion of digital trade rules,and the difference in autonomous FTA effects significantly inhibits the quality of conclusion of digital trade rules.From the perspective of sub-clauses,the conclusion quality of data management clauses,privacy protection clauses,intellectual property protection clauses as well as dispute settlement and cooperation clauses is affected by the third-party effect.From a country perspective,compared with"South-South"economies,"North-North"economies are more sensitive to the difference in autonomous FTA effects;compared with"North-North"economies,the negative effect of the difference in autonomous FTA effects is smaller between"South-North"economies.
