行政公益诉讼制度的运行困境与应对策略

摘　　要：自行政公益诉讼制度正式确立以来,在保护国家和社会公共利益、监督行政机关合理行使公权力、提高治理效能等方面显现出较大的优势,取得了一定的成效,但同时也存在一些问题。为此,一方面要厘清构建起行政公益诉讼制度的基本理论和当前制度发展的现状,明确现行制度运行中检察机关、行政机关、审判机关之间协调合作的关系和界限,特别要注重行政公益诉讼中检察机关在其中的性质与角色。另一方面,通过对我国行政公益诉讼发展过程中的实践情况进行反思,总结各地出现的司法政策和典型案例,提出当前存在运行机制不完善、受案范围不均衡及宣传工作不到位等问题。最后,通过提出建立健全法律规范、拓宽案件的线索举报渠道、加大与公益诉讼有关内容的宣传力度等措施,以此更好地完善我国行政公益诉讼制度。Since the establishment of the administrative public interest litigation system,it has shown considerable advantages in protecting national and social public interests,supervising the reasonable exercise of public power by administrative organs,and improving governance efficiency.It has achieved certain results,but also some problems.Therefore,on the one hand,it is necessary to clarify the basic theory and current status of the system,clarify the relationship and boundaries between the procuratorial organs,administrative organs,and judicial organs in the operation of the current system,and pay special attention to the nature and role of the procuratorial organs in administrative public interest litigation.On the other hand,by reflecting on the practical situation of the development of administrative public interest litigation in China,the judicial policies and typical cases that have emerged in various places are summarized,and the problems of imperfect operation mechanisms,uneven case scope,and insufficient publicity efforts are identified.Finally,by proposing measures such as establishing and improving legal norms,widening channels for reporting case leads,and intensifying publicity efforts related to public interest litigation,we can better improve the administrative public interest litigation system in China.
