摘　　要：《核与辐射安全行政处罚裁量基准》的制定旨在规范核与辐射安全领域的行政处罚行为,并着力提升执法水平。重点探讨了该基准的编制背景、目标、法律依据、裁量标准、计算方法。该基准明确了罚款金额的设定方式,并对不同情节进行了详细考量,为执法人员提供了具体指引,增强了处罚的规范性。针对特殊情况,该基准给出了相应处理原则,提升了行政处罚的灵活性和精确性。The establishment of the“Nuclear and radiation safety administrative penalty discretionary criteria”is aimed at regulating administrative penalty actions in the field of nuclear and radiation safety and at enhancing the level of law enforcement.The background,objectives,legal basis,discretionary standards,and calculation methods for the criteria were thoroughly discussed.The criteria clarified the method for setting fine amounts and detailed considerations given for different circumstances,providing specific guidance to law enforcement officers and strengthening the standardization of penalties.Principles for handling special cases were outlined in the criteria,enhancing the flexibility and precision of administrative penalties.
