摘　　要：National varieties in implementing treaties bring about indeterminacy in states'compliance with treaty obligations.While the reality of the international society makes uniform treaty implementation an unattainable goal,it is feasible to promote treaty implementation in domestic courts by ensuring consistent and predictable application of the presumption of conformity.The principle of the presumption of conformity is widely established in states as an aid to domestic law interpretation and a means of indirectly implementing treaties.This article focuses on the legislation,practice and scholarship on the application of the presumption of conformity in China,conducting an empirical study on the application of the principle of the presumption of conformity in China.This article proposes the establishment of a collaborative framework to promote the application of the presumption of conformity at the domestic level.The Treaty Act should be made to provide major guidance for the courts of China to apply treaties and the principle of the presumption of treaties.At the international level,it suggests that a soft law instrument,the Draft Guidelines on the Application of the Presumption of Conformity,should be formulated by the International Law Commission.各国在执行国际条约过程中展现出的差异性,构成了条约义务履行的不确定性因素。一致性解释原则作为联结国内法与国际法的桥梁性制度工具,不仅是国内法解释的辅助机制,更是间接实施国际条约的有效手段,在全球范围内得到了广泛承认与确立。本文探讨一致性解释原则的理论基础与实践应用,聚焦该原则在中国的具体适用情况,通过实证分析揭示了其运行成效与面临的挑战。为促进一致性解释原则在国际条约实施中的更广泛应用,本文建议在国内法层面,建立条约缔结、批准和适用部门之间的合作机制,同时制定专门的条约法,为我国法院在解释与实施条约时提供系统性指导性规范;在国际法层面,呼吁国际法委员会起草《一致性解释原则适用指引草案》等软法性文件,以增进国际共识,推动全球范围内一致性解释原则适用的标准化与规范化进程。
