摘 要:时至今日,随着社会生产力的发展带动的人们生活水平的提高,残疾人群体已经不再像过去连基本的生存都无法保障,但是残疾人群体就业观念不正确,就业竞争力小的就业困境依旧存在,也导致许多残疾人即便拥有正常的工作能力也难以自食其力。虽然我国宪法之中没有明确规定残疾人的劳动权利和就业保障,但其也明确了公民有劳动的权利和义务。残疾人群体的劳动权利和就业权利保障是我国人权保障的重要部分,也是对宪法尊重和保障人权这一基本原则的重要践行。本文通过研究靖安县残疾人群体的总体就业情况,运用阿玛蒂亚·森可行能力理论并详细了解该县的残疾人构成及就业情况下,分析问题产生的原因并提出对策。To this day,with the development of social productivity driving the improvement of people’s living standards,the disabled group is no longer unable to guarantee basic survival like in the past.However,the employment concept of the disabled group is incorrect,and the employment dilemma of low competitiveness still exists,which leads to many disabled people finding it difficult to rely on themselves even if they have normal work abilities.Although the Constitution of our country does not explicitly stipulate the labor rights and employment security of people with disabilities,it also clarifies that citizens have the right and obligation to work.The protection of the labor and employment rights of the disabled group is an important part of China’s human rights protection,and also an important practice of the basic principle of respecting and safeguarding human rights in the Constitution.This article studies the overall employment situation of the disabled population in Jing’an County,applies Amartya Sen’s feasible ability theory,and provides a detailed understanding of the composition and employment situation of the disabled population in the county.It analyzes the reasons for the problems and proposes countermeasures.
