摘　　要：随着网络时代的到来,人们的性权利观产生了显著变化,性自主权也面临着新风险。网络的传播效应促使性别平等观念不断强化,重构了性自主权的内涵;网络的平权效应使权力差距得到弱化,提升了被害人维护性自主权的能力,强化了刑法对性自主权的保护作用。但是,网络在交流方式上的异化,产生了新的性犯罪方式;网络对性犯罪外部诱因与内在动机的强化,扩张了性犯罪的范围。我国的刑法对此进行了积极回应,通过对性犯罪罪名的修改与增加、性犯罪行为的扩张解释以及性犯罪法定刑的提高等方式,更加周全地保护了性自主权。然而,伴随着网络技术的快速发展,我国性犯罪刑法规制的局限性也逐渐凸显。对此,应深入研究性犯罪在网络环境下的演变及其规律,以完善我国性犯罪的刑法防治体系。With the advent of the Internet age,people′s views on sexual rights have changed significantly,and sexual autonomy is facing new risks.On the one hand,the internet has a positive effect on the protection of sexual autonomy.The dissemination effect of the Internet contributes to the concept of gender equality,leading to the reconstruction of the connotation of sexual autonomy.The equalizing effect of the Internet has reduced the power distance,accumulating power of victims to maintain sexual autonomy.On the other hand,the Internet has a negative effect on sexual autonomy.The Internet′s alienation of communication has created new ways of sexual crime.The strengthening of external incentives and internal motives for sexual crimes by the Internet has expanded the number of sexual crimes.In response,criminal legislation and judiciary have made active adjustments,through the revision of the crime of forced indecency,the establishment of the crime of sexual assault by persons in charge of care,the expansion of the interpretation of‘indecency’and the increase in thepenalties for sexual crimes,to address new issues in the protection of sexual autonomy.However,with the rapid development of the Internet,the limitations of China′s criminal law regulations on sexual crimes have gradually become apparent.In response,it is necessary to delve into the evolution and patterns of sexual crimes in the digital environment to improve China′s criminal law system regarding sexual offenses.
