摘　　要：自以“利益”“目的”为核心的利益法学提出以来,法律体系逐渐从封闭走向开放。基于对目的功能定位理解不同,在我国刑法领域中形成了形式解释与实质解释的对立。目的解释中的目的之确认对于正确理解法规范含义,解决疑难案件具有重要意义。现下目的解释的目的确认方法表现出恣意性特征,继而导致解释结论具有类推解释的嫌疑,使得犯罪圈不断扩大。为了弥补这些不足,应当从探寻与限缩两个方面对目的确认的路径进行建构。从目的藉由条文呈现的特点出发,在探寻目的过程中,可以采用语言学的分析方法,以词句作为基础,发挥汉语词义、语法、语义的分析作用。为了防止解释结论的类推化,确认目的时应当检视是否符合二阶比例原则的适当性与必要性原则要求。Since the interest jurisprudence with"interest"and"purpose"as its core was put forward,the legal system has gradually moved from closed to open,which has a significant impact on the world.Based on the different understanding of the purpose function orientation,there is a contradiction between formal interpretation and substantive interpretation in the field of criminal law in China.The confirmation of the purpose in the purpose interpretation is of great significance to correctly understand the meaning of legal norms and solve difficult cases.The current methods of confirming the purpose of purpose interpretation show the characteristics of arbitrariness,which leads to the suspicion of analogy interpretation in the interpretation conclusion and expands the criminal boundary.In order to make up for the deficiencies,we should construct the path of goal confirmation from the two aspects of exploration and limitation.Starting from the characteristics of the purpose presented by the articles,in the process of exploring the purpose,linguistic analysis methods can be used to play an analytical role in the meaning,grammar and semantics of Chinese words based on words and sentences.In order to prevent the analogy of the interpretation conclusion,when confirming the purpose,we should check whether it meets the requirements of the principle of appropriateness and necessity of the second order proportion principle.
