智能时代数据商业利用的法律边界

摘　　要：数字经济的发展要求数据作为生产要素在市场流通,人工智能的发展加快了市场流通数据的商业利用。数据商业利用涉及多方利益。在数据共用的内部层面上,数据商业利用牵涉数据的原始来源者、原始数据的生成者、数据的利用者的相互关系;在数据市场流通的外部层面上,数据商业利用牵涉数据的利用者、基于数据的消费者、数据交互利用的竞争者三者之间的相互关系。数据商业利用应以不侵犯相对方的合法利益作为法律边界。在数据共享层面上,数据商业利用以不侵害原始来源者的人格权或原始数据生成者的商业秘密权益为限;在数据市场流通层面上,数据商业利用以不侵犯消费者或相关市场竞争者的权益为限。The development of the digital economy requires that data be circulated in the market as a factor of production,and the development of artificial intelligence has accelerated the commercial utilization of data circulating in the market.The commercial utilization of data involves multiple interests.At the internal level of data sharing,the commercial utilization of data involves the interrelationships among the original source of data,the generator of original data and the user of data;at the external level of data market circulation,the commercial utilization of data involves the interrelationships among the user of data,the consumer based on the data,and the competitors in the interactive utilization of data.The commercial utilization of data should not infringe upon the legitimate interests of the other party as its legal boundary.At the level of data sharing,commercial utilization of data should be limited to the extent that it does not infringe on the personality rights of the original source or the trade secret rights and interests of the original data producer;at the level of data market circulation,commercial utilization of data should be limited to the extent that it does not infringe on the rights and interests of the consumers or the relevant market competitors.
