摘　　要：数字政府建设深刻地改变了行政权的样貌,也在救济法领域对行政法制度及理论体系提出了挑战。一方面,自动化行政违法特殊的权利减损属性加大了监督与救济的难度;另一方面,既有的救济手段难以有效地发挥其应有功能。与此相对,检察机关同时具备相应的规范基础与技术能力,也具备相当的监督优势。为此,检察机关要坚持“数据—行为”混合监督的基本监督模式,破除检察监督之中面临的技术壁垒并防范权力异化的风险,通过运用确定自动化行政违法的监督范围、合理使用检察建议等制度手段,以及明确与完善行政数据的收集与对接机制、建立数字化的行政数据监督体系构架等具体手段,进一步完善自动化违法行政检察监督体系。The construction of digital government has profoundly changed the appearance of the administrative power,and also challenged the administrative law system and theoretical system in the field of relief law.On the one hand,the special property of the automatic administrative violation of the right impairment increases the difficulty of its supervision and relief;On the other hand,the existing relief means are difficult to play their due functions effectively.In contrast,procuratorial organs have the corresponding legal basis and technical ability,and have considerable supervisory advantages.To this end,procuratorial organs should adhere to the basic supervision mode of data-behavior mixed supervision,eliminate the technical barriers and the risk of power alienation faced by procuratorial supervision,and expand the scope of supervision of automated administrative violations,clarify and improve the collection and docking mechanism of administrative data,and build a digital administrative data supervision system framework.Construct a perfect automatic administrative inspection and supervision system.
