摘　　要：尽管人权意义上的生育权、公权意义上的生育权以及社会权意义上的生育权已经受到了理论界较多的关注,但是私法意义上的生育权却没有得到应有的重视。本文全面地揭示了生育权的私权本质,正确界定了生育权的人格权属性,阐明了生育权的私权特征,阐述了生育权私法关系及其权能构成,有利于深化生育权私权理论研究,有利于指导生育权私法制度的构建,还有利于完善和强化生育权的私法保护。Although the reproductive rights in the sense of human rights,public rights and social rights have received much attention from the theoretical community,the reproductive rights in the sense of private law have not received the attention they deserve.This article comprehensively reveals the nature of private rights in reproductive rights,correctly defines the attributes of personality rights in reproductive rights,reveals the characteristics of private rights in reproductive rights,and elaborates on the construction of the relations of private law in reproductive rights and their powers and functions,which is conducive to deepening the theoretical research of private rights in reproductive rights,guiding the construction of the private law system of reproductive rights,and improving and strengthening the private law protection of reproductive rights.
