摘  要:因对强制退休制度和基本养老保险待遇的不同理解,学界难以对超过法定退休年龄再就业职工的用工关系进行准确定性。本文通过考察“退休”的法律属性,探讨退休、基本养老保险待遇与劳动权的关系,明确退休是劳动者的法定权利,与劳动权并不排斥,养老保险待遇则属于社会保障领域,与劳动权也不冲突。在相关职工劳动关系的认定上,应当在判断劳动者身份的基础上坚持从属性的实质判断标准。Because of different understandings of the mandatory retirement system and basic pension insurance benefits,it is difficult for academics to accurately characterize the employment relationship of workers who are re-employed beyond the statutory retirement age.This article examines the legal attributes of"retirement"and discusses the relationship between retirement,basic pension insur‐ance benefits and labor rights,making it clear that retirement is a legal right of the worker,not exclusive to labor rights,and that pen‐sion insurance benefits belong to the field of social security and are not in conflict with labor rights.In determining the labor relations of the workers concerned,the substantive criteria of subordination should be adhered to on the basis of their status as workers.
