摘　　要：司法鉴定是专利侵权诉讼中的重要环节,然而由于生物领域的特殊性如序列的抽象性、样本的变异性和技术标准的多样性等给司法鉴定带来了诸多问题。文章结合具体案例讨论并分析了司法鉴定在生物领域中存在鉴定样本获取和保存困难、鉴定方法的技术局限性等问题,又从等同特征的判断和检测手段不同导致鉴定结论震荡两个角度探讨了生物领域司法鉴定的可信度,以及他国司法鉴定环节中值得借鉴之处。随着《关于加强知识产权鉴定工作的指导意见》的出台,有望进一步推动我国司法鉴定制度的完善,进而克服生物领域司法鉴定的诸多问题。ness of biological sequences,the variability of samples and the diversity of technical standards,etc.,have brought a lot of problems to judicial appraisal.This paper discusses and analyzes the diffi culties in obtaining and preserving identifi cation samples and the technical limitations of identifi cation methods in the biological fi eld,and discusses the credibility of the judicial appraisal in the biological fi eld from the perspectives of the judgment of the equivalent features and the shock of the identifi cation conclusions caused by the diff erent means of detection,and summarizes the judicial appraisal system in other countries.With the introduction of the Guiding Opinions on Strengthening the Work of Intellectual Property Appraisal,it is expected to further improve the development of judicial appraisal in China,so as to overcome many problems of judicial appraisal in the biological fi eld.
