摘　　要：行政复议“程序空转”是指复议程序的低效率乃至无效率,由于实体争议未得到化解,造成了行政、司法资源的浪费。从制度运行流程来看,在原行政机关执行复议决定中、行政复议过程中、复议和其他制度的衔接中都存在程序空转现象。从程序空转的成因来看,既有执法主体履职能力不足的原因,也存在法律规范层面行政复议受理条件不明确、审理流程局限性、变更决定存在适用困境等原因,制度衔接层面同样存在不完善之处。为化解程序空转现象,宜从畅通复议救济渠道、提升复议纠错力度、完善复议衔接机制三方面着手,激活行政复议实质化解争议的主渠道功能。The term“procedure idling”in administrative reconsideration refers to inefficiencies in the reconsideration process,where the substantive dispute remains unresolved,leading to a waste of administrative and judicial resources.From the perspective of system operation,procedural idling occurs at several stages:during the implementation of reconsideration decision by the original administrative body,within the administrative reconsideration process itself,and in the connections between reconsideration and other systems.The causes of procedural idling are multifaceted.They include a lack of capacity among law enforcement agencies to fulfill their duties,unclear legal standards for accepting administrative reconsideration cases,limitations within the trial process,and challenges in implementing changes through reconsideration decisions.Additionally,there are gaps in the cohesive mechanisms between systems involved in administrative reconsideration.In order to resolve the issue of procedural idling,it is advisable to revitalize the primary function of administrative reconsideration as a tool for effectively resolving disputes.This can be achieved through three aspects:ensuring unimpeded access to reconsideration relief channels,enhancing efforts to correct error,and improving the cohesion mechanisms that connect various aspects of the reconsideration process.
