摘 要:新《行政复议法》扩大了行政复议前置范围,为行政复议主渠道建设提供了重要基础。复议前置具有促进行政机关自我控制、扩大权利保护、减轻法院负担、降低行政争议解决成本四大价值。此四大价值的实现需要复议制度多个方面的共同作用,包括复议前置范围设置与适用、复议审查优势的运用、复议与行政诉讼纵向衔接的加强等。《行政复议法》对复议前置制度的设计尚不能满足复议前置价值的实现,需要从复议前置范围的合理界定、复议前置适用例外情形的列举、复议阶段部分审查结论效力的确立、复议审查程序与复议前置逻辑的对应、复议前置制度正当性的日常宣示五个方面进行完善。The new Administrative Reconsideration Law of China has broadened the scope of proactive administrative reconsideration,providing a crucial foundation for the construction of administrative reconsideration as the primary channel for solving administrative disputes.As a prelude to administrative litigation,proactive administrative reconsideration offers four major benefits:promoting the self-regulation within administrative bodies,expanding the protection of rights,reducing the burden on courts,and reducing the costs associated with resolving administrative disputes.To realize these benefits,a comprehensive approach is needed,encompassing several aspects of the reconsideration system.These include clearly defining the scope of proactive administrative reconsideration,leveraging the advantages of administrative reconsideration reviews,and strengthening the link between administrative reconsideration and administrative litigation.Currently,the Administrative Reconsideration Law does not fully support the realization of these values.Specifically,there is a need to define the scope of the proactive administrative reconsideration more clearly,outline the applicable exceptions,and ensure the effective implementation of administrative reconsideration.
