摘 要:“公权”作为监察对象的单一识别标准并不能满足后监察体制改革时代的发展要求。公权力机关的组织都是人员与财物的组合体,故而从宪法规定的“国家保护社会主义的公共财产”出发,需要以“财物”这一全新视角来重新考量监察对象。在宪法概念“公共财产”的统领之下,各个部门法中关于“公共财产”类似概念呈现出“物”和“财”两大特性,这也是监察法领域中“国家资财”概念所包含的两大特性。进而可以考虑将“公共财产”作为监察对象识别标准之一,搭配“公权”进行监察对象的综合识别。这样不仅可以从监察法领域回应宪法中关于“保护公共财产”的条文规定,还能达到精准拓展、识别监察对象,助力实现国家监察全覆盖。The use of“public authority”as the sole criterion for identifying supervisory targets is insufficient to address the evolving needs of China’s post-reform supervisory system.Public authority institutions,which encompass both personnel and property,require a broader framework for effective supervision.In light of the constitutional mandate that“the state protects socialist public property,”there is a compelling need to incorporate the concept of“property”into the identification of supervisory targets.Under the constitutional framework of“public property,”similar concepts across various sectoral laws reveal two distinct attributes:“objects”and“assets.”These attributes correspond to the notion of“state resources”within the context of supervisory law.As such,“public property”should be considered a key criterion alongside“public authority”in the identification of supervisory targets.This dual approach not only aligns with constitutional provisions regarding the protection of public property but also enhances the precision and comprehensiveness of supervisory target identification,thereby facilitating the realization of a fully integrated national supervision system.
