摘 要:建设用地需求量居高不下,而面对我国当前农村土地入市流转存在的政府垄断以及非法入市等问题,极大程度上展现出当前集体经营性建设用地入市流转法律制度的缺失。基于此,本文对集体经营性建设用地范畴以及入市流转面临的法律困境进行研究,结合集体经营性建设用地当前入市流转的两种具体方式进行分析,提出了落实土地规划、加强确权管理、流转收益合理分配、完善市场监管与保障土地增收等方式,全面推进集体经营性建设用地实现规范性有序化的入市流转。The demand for construction land is still high, and in the face of the problems of government monopoly and illegal market entry in the current rural land market circulation in China,the current legal system of collective operating construction land market circulation is largely lacking.Based on this, this paper studies the scope of collective operating construction land and the legal difficulties faced by the market entry and transfer, and proposes ways to implement land planning,strengthen the management of ownership confirmation, reasonably distribute the transfer income,improve market supervision and ensure the increase of land income, and comprehensively promote the standardized and orderly market entry and transfer of collective operating construction land.
