治疗法理学视角下离婚冷静期制度的优化

摘　　要：离婚冷静期制度功能的有效发挥对维护家庭的稳定有一定积极作用。通过治疗法理学视角可知,离婚冷静期制度实际上在人的情感层面具有两重预期功能:一是冷静处理争议,提升离婚理性;二是弥合情感创伤,修复家庭情感。但是,离婚冷静期制度也会带来增加诉讼离婚心理倾向、激发施暴与投机的心理,以及影响未婚群体心理预期等非预期的后果。为了离婚冷静期制度功能的最终实现,达成维护家庭稳定之目标,需要分析该制度面临的弃而不用与用而不灵的双重困境,提出冷静期内的情感干预措施,对离婚冷静期制度予以优化。The divorce cooling-off period,when effectively implemented,plays a significant positive role in preserving family stability.Through the lens of therapeutic jurisprudence,the system of divorce cooling-off period,in reality,has,a two-fold expected function at the emotional level:One is to calmly deal with disputes and enhance the rationality of divorce,and the other is to heal emotional trauma and restore family emotions.However,the system of divorce cooling-off period also brings about unintended consequences,including an increased psychological propensity towards litigious divorce,the incitement of mentalities of violence and speculation,and the disruption of psychological expectations within unmarried groups.To realize the ultimate function of the divorce cooling-off period system and the goal of maintaining family stability,it is necessary to analyze the dual dilemmas of abandonment and underutilization faced by the system,and to propose emotional interventions during the cooling-off period,so as to optimize the divorce cooling-off period system.
