风险预防视域下我国页岩气开发环境风险法律规制研究

摘　　要：充分认识页岩气开发中的各类环境风险,以法律手段进行合理预防和有效规制,是应对页岩气开发环境负外部性问题、加快构建清洁低碳安全高效的新型能源体系、实现能源供应安全的重要保障。能源安全与环境安全的协同性对页岩气开发环境治理提出了新要求,我国页岩气开发环境风险法律规制需要在风险预防视域下进行重新审视,其法律依据不足、规制体制受限、制度内容不明以及监管机制尚不健全的典型问题亦亟待解决。对此,应引入风险预防原则,从法律架构推演、主体范围优化、制度内容补足、监管机制创新四条路径整体有序推进,实现对页岩气开发环境风险的预防式治理。Fully understanding all kinds of environmental risks in shale gas development and carrying on the reasonable prevention and effective regulation by legal means are important guarantees to overcome the negative environmental externalities of shale gas development,accelerate the construction of clean,low-carbon,safe and efficient new energy system,and realize the security of energy supply.The synergy of energy security and environmental security puts forward new requirements for environmental governance of shale gas development.China's shale gas development environmental risk legal regulation needs to be re-examined from the perspective of risk prevention,and its typical problems such as insufficient legal basis,limited regulatory system,unclear system content and imperfect regulatory mechanism need to be solved urgently.In this regard,the principle of risk prevention should be introduced,and the four ways of legal framework deduction,subject scope optimization,system content complement,and regulatory mechanism innovation should be promoted in an overall and orderly way,so as to realize preventive governance of environmental risks of shale gas development.
