建筑施工企业资质违法行为监管信息机制优化问题研究

摘　　要：为了保障建筑质量和市场秩序,克服市场失灵,我国建立了建筑施工企业资质监管制度。建筑企业资质制度的特征是建立行政许可制度,规定建筑施工企业的不同等级,并要求在规定的等级范围内承揽工程。其实质是通过审查建筑施工企业资质条件,来间接保障建筑工程质量。该制度的核心是监管信息机制。监管机关从建筑施工企业的经营行为中获取真实、完整的信息,以评定建筑施工企业是否符合其资质等级要求,因此,获取资质违法行为信息成为监管信息机制的关键。资质违法行为具有特殊性,能够有效破坏资质监管的信息机制,导致监管目标难以实现。监管制度改革的有效途径在于是否充分获取资质违法行为信息。人民法院在审理建设工程施工合同纠纷案件时,能够发现大量违法行为和违法所得的情况。监管机关与司法机关协同治理,将违法行为和违法所得的信息通报监管机关,将涉嫌严重违法案件移送监管机关,是监管信息机制优化的有效途径。In order to ensure construction quality and market order,and overcome market failure,China has established a qualification supervision system for construction enterprises.The characteristic of the qualification system for construction enterprises is to establish an administrative licensing system,which specifies the different levels of construction enterprises and requires them to undertake projects within the specified level range.The essence is to indirectly ensure the quality of construction projects by reviewing the qualification conditions of construction enterprises.The core of this system is the regulatory information mechanism.Regulatory authorities obtain true and complete information from the business operations of construction enterprises,and evaluate whether they meet their qualification level requirements.Therefore,obtaining information on illegal activities related to qualifications has become the key to the regulatory information mechanism.The illegal behavior of qualifications will disrupt the information mechanism of qualification supervision,making it difficult to achieve regulatory goals.The effective way to reform the regulatory system is to fully obtain information on illegal activities related to qualifications.When the people’s court hears disputes over construction contracts,it can discover a large number of illegal acts and illegal gains.Collaborative governance between regulatory authorities and judicial authorities,which report illegal activities and illegal gains to regulatory authorities and transfer suspected serious illegal cases to regulatory authorities,is an effective way to optimize regulatory information mechanisms.
