摘　　要：我国沿海滩涂法律属性在政府部门尚未有定论,在学术界也存在争议。学术界主要有“一元论”和“二元论”两种观点。每个学说各有侧重,但都难以全面反映沿海滩涂法律属性的多元性和综合性特点。根据最新法律规定,沿海滩涂中潮上带滩涂法律属性为土地,潮间带和潮下带滩涂法律属性为海域,此外,沿海滩涂在符合湿地定义和保护条件的情况下,还可以被视为湿地。从沿海滩涂权利归属和利益配置的角度看,其法律属性在整体上具有综合性特点。沿海滩涂综合性法律属性在我国法律体系中具有明确的现实意义和内在逻辑性,不仅能为生态保护提供充分的法理支撑,还能指导综合保护策略的制定,并可以促进综合监管机制的建立与完善。The legal attributes of coastal tidal flat in China have not been definitively determined by government departments,and there is also controversy in the academic community.The main academic viewpoints are the"monistic"and"dualistic"perspectives.Each viewpoint has its own emphasis,but neither can fully reflect the pluralistic and comprehensive characteristics of the legal attributes of coastal tidal flat.According to the latest legal provisions,the legal attributes of the intertidal zone and submerged zone are sea area,while the legal attribute of the supratidal zone is land.In addition,coastal tidal flat can be regarded as wetland in accordance with the definition and protection conditions of wetland.From the perspective of the ownership of rights and the allocation of interests of coastal tidal flat,its legal attributes as a whole have comprehensive characteristics.The comprehensive legal attributes of coastal tidal flat have clear practical significance and inherent logic in China legal system,not only providing a sufficient legal basis for ecological protection,but also guiding the formulation of comprehensive protection strategies and promoting the establishment and improvement of comprehensive supervision mechanisms.
