摘　　要：制定民营经济促进法是中国式现代化全面推进强国建设关键时期助力民营经济走出困境,实现可持续、低风险和高质量发展的法治保障。民营经济立法的逻辑基础在于,将财富创获权利的平等分配作为立法对象,将促进民营经济主体增进社会财富总量作为立法目的,以遵循民营经济主体利害行为规律及民营经济发展重大利害关系为立法原理,赋予民营经济市场主体财富创获活动配置资源的平等地位,对促进民营经济发展重大利害的政企关系、公平竞争关系予以法律强制性规范调整,对促进民营经济健康发展和民营经济人士健康成长的营商环境予以道德性的“软法”规范调整,通过软硬兼施,实现民营经济增进全社会和每个国民利益和福祉、幸福与尊严总量。The formulation of the Non-state-owned Economy Promotion Law in China serves as a legal safeguard for the private sector to emerge from difficulties and achieve sustainable,low-risk,and high-quality development during the critical period of comprehensively advancing the modernization of the country and building a strong nation.The logical foundation of non-stateowned economy legislation is based on the equal distribution of wealth creation rights as the legislative object,the enhancement of social wealth by non-state-owned economic entities as the legislative purpose,and the adherence to the patterns of behavior and significant interests of private economic entities and development as the legislative principle.It endows non-state-owned economic market entities with an equal status in resource allocation for wealth creation activities,legally regulates the significant interests of government-enterprise relations and fair competition that promote non-state-owned economic development,and morally adjusts the business environment that fosters the healthy development of the non-state-owned economy and the growth of non-state-owned economic practitioners through"soft law"norms.By combining hard and soft regulations,it aims to increase the total benefits and well-being,happiness,and dignity for the whole society and all the citizens through the development of non-state-owned economy.
