摘　　要：《档案法实施办法》更名为《档案法实施条例》背后蕴含着深刻法理考量:其根本逻辑在于原《档案法》第二十六条被删除的修法史,使得国务院立法权能够完整行使。具体而言:一是《档案法》的配套法规制定要求已不存在特别限制;二是国务院立法权行使的命名要求;三为制定《档案法实施条例》的创制性内容所需。更名带来的实践意蕴包括更好彰显《档案法实施条例》的法律位阶、预留出档案事业发展的立规空间以及引发过渡期的法规适用三个方面。《档案法实施条例》的出台是档案事业发展史上的重要里程碑事件,理顺了档案事业发展的体制机制,档案法治体系得以更加融贯,将推动依法治档事业不断向前发展。The renaming of the Measures for the Implementation of Archives Law to the Regulations for the Implementation of Archives Law is based on profound legal considerations:its fundamental logic lies in the history of amendments in Article 26 of the original Archives Law,which was deleted,enabling the State Council's legislative power to be fully exercised.Specifically,firstly,there are no special restrictions on the formulation of supporting regulations for the Archives Law;secondly,the renaming requirements from the exercise of legislative power by the State Council;thirdly,the necessity for the development of innovative content in the Regulations for the Implementation of Archives Law.The practical implications brought about by the renaming include three aspects:better highlighting the legal status of the Regulations for the Implementation of Archives Law,reserving regulatory space for the development of the archival industry,and triggering the application of transitional regulations.The promulgation of the Regulations for the Implementation of Archives Law is an important milestone event in the development history of the archival industry,which has streamlined the institutional mechanism for the development of the archival industry,made the legal system of archives more integrated,and will promote the continuous development of the rule of law in archival undertakings.
