摘　　要：标准必要专利(SEP)纠纷近年来频繁发生,引发国际社会对其法律规制的关注。本文以WTO框架为视角,分析了《TRIPS协定》和《TBT协定》在SEP治理中的作用及不足,并提出进一步完善国际规则的建议,包括增设SEP条款、引入FRAND原则、加强强制许可的操作性规定等,以促进技术共享与公平竞争。Standard-essential patent(SEP)disputes have occurred frequently in recent years,drawing the attention of the international community to their legal regulation.This paper analyzes the roles and shortcomings of the TRIPS Agreement and the TBT Agreement in the governance of SEP from the perspective of the WTO framework.It also proposes suggestions for further improving international rules,including the addition of SEP provisions,the introduction of the FRAND principle,and the enhancement of operational regulations for compulsory licensing,aimed at promoting technology sharing and fair competition.
