地方预重整类型实证研究--基于预重整地方规范性文件的样本分析

摘　　要：继温州、深圳公布预重整规范性文件之后,全国各级地方法院纷纷制定了预重整司法文件,在各自辖区探索实践预重整制度适用模式,逐渐形成了申请重整前庭外预重整、申请预重整或重整后法院受理案件前庭内预重整、既可以庭外预重整又可以庭内预重整三种类型。这三种类型中以申请预重整或重整后法院受理案件前庭内预重整为多数地方司法文件的意见,成为本土化主流预重整模式,对于提升办理破产质效和提高困境企业重整成功率、压缩重整时间并降低司法成本、优化法治化营商环境有着重要的作用和积极的司法现实意义。After the release of normative documents on pre restructuring in Wenzhou and Shenzhen,local courts at all levels across the country have formulated judicial documents on pre-restructuring,explored and practiced the application mode of pre-restructuring system in their respective jurisdictions,gradually formed three types:pre-restructuring outside the court before applying for restructuring,pre-restructuring inside the court before applying for pre-restructuring or after the court accepts the case,and pre-restructuring both outside and inside the court.Among these three types,the opinion of applying for pre-reorganization or pre-reorganization before the court accepts the case after reorganization is the majority of local judicial documents,which has become the main pre-reorganization model in localization.It plays an important role in improving the quality and efficiency of bankruptcy handling,increasing the success rate of difficult enterprise reorganization,compressing reorganization time,reducing judicial costs,and optimizing the legal business environment,and has positive judicial practical significance.
