摘　　要：生态保护红线作为生态文明的制度创新,其生态安全底线的功能定位及“红线”特质,决定了只有通过严格管控才能实现制度预期。目前,生态保护红线在全国范围内已经全面划定,进入落地实施的关键期,但如何建立与制度理念和要求相适应的管控机制仍在探索期。以长腰山过度开发为代表的一些生态环境督查案件暴露出我国生态保护红线管控机制的不健全问题。分析表明:生态保护红线依法管控的法制体系化和权威性不足、管理体制与制度理念不适应、内涵和核心功能认识不清导致的管理标准适用混乱、法律责任制度缺失是问题的原因。为此,需要从推进系统立法、优化管理体制、建立标准化管理体系、构建责任体系等方面进行完善。As an institutional innovation of ecological civilization,the red line of ecological protection,with its functional orientation and“redline”characteristics,determines that the institutional expectations can only be realized through strict control.At present,the ecological protection redline has been fully delineated nationwide and has entered a critical period of implementation.Yet,how to establish a control mechanism compatible with institutional concepts and requirements is still in the exploratory stage.Some ecological environment inspection cases,represented by the overdevelopment of Changyao Mountain,have disclosed the inadequacy of China's ecological protection redline control mechanism.The analysis shows that the lack of legal systematization and authority in the legal control of ecological protection redlines,the unsuitability of management systems and institutional concepts,the unclear understanding of their connotations and core functions,and the confusion in the application of management standards and the lack of legal responsibility systems are the causes for the problems.To this end,it is necessary to improve the system legislation,optimize the management system,establish a standardized management system,and build a responsibility system.
