摘　　要：类案同判是形式正义原则在司法裁判领域中的根本要求。类案与同判认定标准不明确、类案检索的技术障碍及指导案例制度、案例库建设的不完善阻滞了类案同判的实现进程。在智慧司法建设背景下,充分利用大数据、人工智能技术,建立健全类案识别机制、案件检索机制、指导案例制度,完善司法责任制,为类案同判的实现提供技术上的支撑和保障,规范法官自由裁量权,实现“法律面前人人平等”原则,符合民众的思维逻辑和心理预期,消除司法不公导致的负面影响,维护社会和谐稳定。Treating like case alike is a fundamental requirement of the principle of formal justice in the field of judicial judgment.The unclear criteria for determining similar cases and judgments,technical barriers to similar case retrieval and guidance case systems,and incomplete case library construction have hindered the implementation process of treating like case alike.In the context of smart judicial construction,fully utilizing big data and artificial intelligence technology,establishing and improving mechanisms for identifying and retrieving similar cases,guiding case systems,improving judicial responsibility systems,providing technical support and guarantees for the treating like case alike,regulating judges'discretion,realizing the principle of"equality before the law",in line with the thinking logic and psychological expectations of the people,eliminating the negative impact of judicial injustice,and maintaining social harmony and stability.
