新时代“枫桥经验”视阈下完善横琴粤澳深度合作区调解机制研究

摘　　要：横琴粤澳深度合作区肩负着丰富“一国两制”实践新示范、推动粤港澳大湾区建设新高地的重大使命。调解机制以其高度的灵活性、包容性和便利性,成为深合区多元争议纠纷解决的重要方式之一。同时,“枫桥经验”作为我国解决纠纷、社会治理的智慧结晶,在新时代背景下焕发勃勃生机,对完善横琴粤澳深度合作区调解机制具有重要的启示作用。当前,深合区调解机制的建设虽取得一定成效,但依然存在调解立法不健全、调解体系差异较大、调解机制衔接有待加强的现实挑战。对此,在新时代“枫桥经验”所蕴含内在价值的启示与指引下,应坚持以“三宜并重”引领调解制度发展、以“三治融合”推动调解机制衔接、以“三共一体”深化调解机制合作、以“三化协同”提升调解机制质量,从而为推动横琴粤澳深度合作区法治建设、提升治理水平提供有益参考。Guangdong-Macao in-Depth Cooperation Zone in Hengqin shoulders the important mission of enriching the new demonstration of the practice of"One Country,Two Systems"and promoting the construction of the Guangdong-Hong Kong-Macao Greater Bay Area.With its flexibility,inclusiveness and convenience,the mediation mechanism has become one of the most important means of resolving multiple disputes in the Cooperation Zone,and has also been beneficial to optimizing the business environment and promoting the integrated development of Hengqin and Macao.The"Fengqiao Experience"in the new era,as the wisdom crystallization of dispute resolution and social governance in China,has an important enlightening role in improving the mediation system of the Guangdong-Macao in-Depth Cooperation Zone in Hengqin.Currently,although the construction of mediation mechanisms in the Cooperation Zone has achieved effects,there are still exist difficulties such as significant differences in mediation systems,incomplete mediation legislation,and the articulation of the mediation mechanism needs to be strengthened.Under the inspiration and guidance of the"Fengqiao Experience"in the new era,it is necessary to adhere"adapt to local conditions,times,and people","the integration of the three governances","the direction of joint construction,governance and sharing","Standardization,precision,and intelligence".
