摘　　要：销毁是数据生命周期的最后一个环节,公共数据所蕴含的公共性决定其销毁行为不同于私物处置,研究公共数据销毁的法律规制,不仅面向公共数据安全管理的实践,而且有助于完善我国数据安全管理的法律体系。通过梳理公共数据销毁的规范依据,掌握公共数据作为公物的运行逻辑,基于公物处置、价值丧失以及自我规制的科学内涵,探索公共数据销毁的规范路径。一是健全公共数据销毁的法律体系,通过明确公共数据销毁的入法方案、明确法律授权以及协调规范效力层级,保持法律规范的融贯性与稳定性;二是加强公共数据销毁的公私协作,通过加强政府的指导与规制、明确第三方安全评估机制以及健全社会公众监督机制,形成法律规制之合力;三是优化公共数据销毁的制度建构,通过设立公共数据销毁的专门组织、采用价值丧失的销毁标准以及制定正当的程序规则,保障公共数据销毁的科学性与正当性。Destruction is the last link in the data life cycle.The public nature of public data determines that its destruction behavior is different from the disposal of private property.Research on the legal regulation of public data destruction is not only aimed at the practice of public data security management,but also conducive to the im⁃provement of my country's legal system for data security management.By sorting out the normative basis for public data destruction,mastering the operating logic of public data as public property,and based on the scientific connota⁃tion of public property disposal,value loss and self-regulation,explore the normative path of public data destruction.First,improve the legal system of public data destruction,maintain the consistency and stability of legal norms by clarifying the legal scheme for public data destruction,clarifying legal authorization,and coordinating the level of normative effectiveness;second,strengthen public-private cooperation in public data destruction,form a joint force of legal regulation by strengthening government guidance and regulation,clarifying third-party security assessment mecha⁃nisms,and improving social public supervision mechanisms;third,optimize the institutional construction of public data destruction,and ensure the scientificity and legitimacy of public data destruction by establishing a special organization for public data destruction,adopting destruction standards with loss of value,and formulating proper procedural rules.
