检察融合赋能未成年被害人保护研究

摘　　要：近年来,未成年人遭受犯罪侵害成为社会关注的热点问题。2021年以来,检察机关推动未成年人检察业务集中统一办理,即能动、集中履行“四大检察”职能,深化融合履职,加强未成年人综合司法保护。本文基于办理的未成年人检察案件,立足未成年被害人保护,就办案中发现的社会治理及融合履行待提升之处,提出针对性的意见建议,如,充分运用检察机关承上启下的诉讼地位,建立健全定期通报、会商机制,整合社会、网络、家庭、学校、政府的保护资源,形成保护合力;积极参与社会治理,注重高质量检察建议的制发;不断强化未检公益诉讼等外探索,拓宽未检公益诉讼线索来源和调查手段;搭建数字化法律监督体系,前移融合履职端口,切实加强事前监督;同时,在融合履职过程中加强未成年被害人隐私权保护,建立统一完善的未成年被害人信息的传递、管理和查询机制,不断推动“六大保护”走深走实。In recent years,the problem that minors suffer from criminal violations have become a hot issue of social concern.Since 2021,procuratorial organs have promoted the centralized and unified handling of juvenile procuratorial affairs,deepen the integration and performance of their duties,and strengthen the comprehensive judicial protection of minors.Based on the juvenile prosecution cases handled and the protection of juvenile victims,this article puts forward targeted opinions and suggestions on the social governance and integration performance,such as making full use of the litigation status of the procuratorial organs,establishing and improving regular notification and consultation mechanisms,and integrating the protection resources of society,Internet,family,schools,and government to form a joint protection force;actively participate in social governance and pay attention to the sanctions of high-quality procuratorial recommendations;continuously strengthen external exploration such as public interest litigation,and broaden the sources of clues and investigation methods of public interest litigation;build a digital legal supervision system and effectively strengthen pre-supervision;Meanwhile,strengthen the protection of the privacy rights of minor victims in the process of integration and performance of duties,establish a unified and perfect mechanism for the transmission,management and inquiry of minor victims’information,and continuously promote the“six major protections”to go deeper and more practical.
