摘 要:《未成年人保护法》自1991年实施以来,经过四次修订,反映了我国在未成年人保护机制构建与发展上的努力。初期存在责任主体不明确、协调机制不健全的问题。地方政府虽牵头成立保护委员会取得成效,但缺乏全国性机构和法律支持,难以实现全面保护。随后,民政部门试点儿童福利、保护政策,逐步统筹福利与保护职能。2020年修订的《未成年人保护法》确立民政部门为未成年人保护协调机制的主要责任部门。2024年的修正进一步明确了法律内涵和定位,未成年人保护机构的发展仍需深入思考,未来或可设立专门保护机构,推动法律向普惠性制度发展。Since its implementation of the Minor Protection Law in 1991,the Law has been revised four times,reflecting China's efforts in the construction and development of the minor protection mechanism.In the early stage,there are some problems of unclear subject of responsibility and imperfect coordination mechanism.Although local governments have taken the lead in setting up protection committees,it is difficult to achieve comprehensive protection without national institutions and legal support.Subsequently,the civil affairs department piloted the child welfare and protection policies,and gradually coordinated the welfare and protection functions.The Law on the Protection of Minors revised in 2020 establishes the civil affairs department as the main department responsible department for the coordination mechanism for the protection of minors.The revision in 2024 further clarifies the connotation and positioning of the law.The development of the protection agencies for minors still needs to be deeply considered.In the future,special protection agencies may be set up to promote the development of the law to the universal system.
