摘　　要：农村土地合法与有序流转是振兴农村经济和推动农业的现代化建设的重要改革方向。土地流转的前提条件是村民享有合法的土地承包经营权,而土地承包经营权的产生源于土地承包合同的有效性。对于村民小组土地承包合同来说,经过法定的村民表决程序是其合法性的重要条件,但违背法定表决程序的村民小组土地承包合同效力问题,至今未有讨论。立法上,影响该类合同效力认定的缺陷主要有合同性质认定无法可依、法律适用不明确和救济途径规定不清晰等方面。因此,需要从明确合同性质、确定法律适用的原则与规则、修改救济途径规则等方面完善相关立法,为认定该类合同的效力提供法律标准,促进农村土地的流转。The legal and orderly transfer of rural land is an important reform direction for revitalizing the rural economy and promoting the modernization of agriculture.The prerequisite for land transfer is that villagers enjoy legal land contract management rights,which arises from the validity of the land contract.For the villagers group land contract,after the statutory villagers voting procedures is an important condition of its legitimacy.However,the issue of the validity of villagers'group land contract in violation of the statutory voting procedure has not been discussed so far.Legislatively,the defects affecting the determination of the validity of this type of contract mainly include:the determination of the nature of the contract can not be relied upon,the application of the law is not clear,and the provisions of the remedies are not clear.Therefore,it is necessary to improve the relevant legislation in terms of clarifying the nature of the contract,determining the principles and rules of the application of the law,and modifying the rules of the remedies,in order to provide legal standards for the determination of the validity of this type of contract,and to promote the transfer of rural land.
