摘　　要：建立有效的法律制度是保护革命文物的关键。我国革命文物立法经历了萌芽起步、曲折探索、调整改革、完善推进四个时期。现行革命文物相关立法虽然数量庞大,为革命文物保护事业的发展提供了有效的制度供给,但在顶层设计、概念界定、形式与内容、责任主体、法律责任、公众参与等方面尚有不足之处。推进革命文物立法,应将完善顶层设计与兼顾地方探索相结合,明确概念界定与细化具体内容相结合,坚持政府主导与提高公众参与相结合,明确责任主体与理顺管理体制相结合,衔接现有法律与增强司法保障相结合。Establishing an effective legal system is the key to protecting revolutionary cultural relics.The exploration of the legislation of revolutionary cultural relics can be divided into four stages,including the germination stage,tortuous stage,adjusting stage and perfecting and strengthening stage.Although the current legislation related to revolutionary cultural relics is huge and provides an effective system supply for the development of revolutionary cultural relics protection,there are still deficiencies in top-level design,concept definition,form and content,responsible subject,legal responsibility,and public participation.To promote the legislation of revolutionary cultural relics,we should combine the improvement of top-level design with taking into account local exploration,the combination of clear concept definition and detailed specific content,adherence to the combination of government leadership and public participation,and the combination of clarifying the main body of responsibility and rationalizing the management system.Existing laws combined with enhanced judicial safeguards.
