摘 要:《美墨加协定》的劳工快速反应机制的创新有其独特的政策背景。一方面,劳工快速反应机制创造性地利用国际条约的强制性执行措施来监督和保障企业有效实施劳工保护标准,这是劳工快速反应机制在传统劳工条款内容上的创新。另一方面,劳工快速反应机制在内容设置上也存在一些不足,这些不足正是美式劳工条款政策意图的本质体现。劳工快速反应机制的设置对全球劳工治理产生了多重影响。对中国而言,既需要警惕美式劳工条款的最新发展动向,及时应对可能存在的风险,又需要适当关注劳工条款的现实发展趋势,结合自身实际情况及时推动我国主导的国际经贸协定劳工条款建设,以更好地提升我国在国际经贸活动中的参与质量。The innovation of the rapid response mechanism for labor in USMCA has its own unique policy background.On the one hand,the labor rapid response mechanism creatively uses the mandatory implementation measures of international treaties to supervise and guarantee the effective implementation of labor protection standards by enterprises,which is an innovation in the content of traditional labor provisions of the labor rapid response mechanism.On the other hand,there are also some deficiencies in the content setting of the labor rapid response mechanism,which is the essence of the American labor clause policy intention.The establishment of labor rapid response mechanism has multiple impacts on global labor governance.For China,it is necessary to be alert to the latest development trend of American labor clauses,to deal with possible risks in a timely manner,and to pay proper attention to the actual development trend of labor clauses,combined with its own actual situation to promptly promote the content construction of China's leading labor clauses of international economic and trade agreements,so as to better improve the quality of China's participation in international economic and trade activities.
