数字时代在线劳动的理论意蕴与法律应对

摘　　要：由网络孪生劳动和网络原生劳动组成的在线劳动具有工作网络化、成果虚拟化,场所分散化、时间碎片化,工作与工作外界限模糊、工作时长确定较为困难的特征,其构成要件体现为形式上用人单位对劳动者时间的占用和实质上劳动者从事用人单位工作内容两个方面。结合在线劳动的理论意蕴,可构建起在微观上关于“隐形加班”审查、离线休息权保障、在线劳动报酬计算和劳动关系存续认定的判断路径;在宏观上应从坚持能动司法理念、提升审判工作绩效、健全多元解纷机制及推动争议在线解决四个方面作出整体应对。Online labor,which consists of network twin labor and network native labor,is characterized by networked work,virtualized results,decentralized places,fragmented time,blurred boundaries between work and offline work,and difficulty in determining working hours,and its constitutive elements are reflected in the occupation of workers'time by the employer in form and the content of the workers'work by the employer in substance.Taking into account the theoretical implications of online labor,a path of judgment can be constructed for the review of"invisible overtime",the protection of the right to ofline rest,the calculation of online labor compensation,and the determination of the continuity of the labor relationship at the micro level;and at the macro level,a holistic response should be made in four aspects,namely,adhering to the concept of active judiciary,enhancing the performance of the trial work,sounding the mechanism of multidisputes resolution,and promoting the online resolution of disputes.At the macro level,the overall response should be made from four aspects:adhering to the concept of dynamic justice,improving the performance of trial work,improving the multiple dispute resolution mechanism and promoting online dispute resolution.
