行政公益诉讼诉前检察建议的优化路径

摘　　要：随着我国社会发展和法治环境的变化,公民对社会公共利益发展状况的关注度不断加强。通过诉前检察建议,司法部门可以更好地履行其监管职能,并且能够更加积极地推动行政公益诉讼,以确保司法部门充分发挥其职能,及时发现并纠正违法违规,维护国家及社会公众利益。最高人民检察院强调,将维护社会公共利益的目标置于司法状态之上,对于促进社会和谐稳定,维护社会生活有序,促进社会和谐稳定,具有十分重要的意义。然而,我国的行政公益诉讼制度尚未完善,缺乏有效的法律规定,因此,这一建议的效果受到了一定的影响。通过对行政公益诉讼的深入探索,发现其实施过程中所面临的一些棘手问题,通过对这些问题进行详细的剖析,以期为改进和优化该领域的工作提供有效的参考。With the change of social development and legal environment in China,citizens pay more attention to the development of social and public interests.Through the pre-litigation procuratorial suggestion,the judicial department can better perform its supervisory functions and more actively promote administrative public interest litigation,so as to ensure that the judicial department timely play its functions,timely detect and correct violations of laws and regulations,and safeguard the interests of the country and the public.The Supreme People's Procuratorate stressed that putting the goal of safeguarding the public interests above the judicial state is of great significance for promoting social harmony and stability,maintaining orderly social life and promoting social harmony and stability.However,the administrative public interest litigation system in China is not yet perfect and lacks effective legal provisions,so the effect of this proposal has been affected to some extent.Through the indepth exploration of administrative public interest litigation,we find some thorny problems in the implementation process of it,and analyze these problems in detail to provide effective reference for improving and optimizing the work in this field.
