摘　　要：BBNJ协定遵约机制构建是国际海洋治理核心,旨在养护和可持续利用海洋生物多样性。需建立综合性框架,包括执行遵守委员会、规则体系、遵约判定及不遵约反应设计。机制以促进性、透明度、非对抗性、非惩罚性为原则,提升履约能力与协作。借鉴《名古屋议定书》,引入惩罚和预防措施,确保有效性、公正性,平衡各国利益,保护发展中国家权益。The construction of the compliance mechanism of the BBNJ Agreement is the core of international ocean governance,aiming at the conservation and sustainable use of marine biodiversity.A comprehensive framework needs to be established,including an executive compliance committee,a regulatory system,a compliance determination,and the design of non-compliance responses.The mechanism is based on the principles of facilitation,transparency,non-confrontation and non-punishment to enhance compliance capacity and cooperation.Drawing on the Nagoya Protocol,punitive and preventive measures are introduced to ensure effectiveness and fairness,balance the interests of all countries,and protect the rights and interests of developing countries.
