基层检察机关完善轻罪治理体系的路径探索——以辽宁省海城市人民检察院实践为样本的分析

摘　　要：近年来,刑事结构轻罪化的趋势愈发明显,构建具有中国特色的轻罪治理体系显得尤为迫切。最高检在检察改革工作规划中明确提出“促进构建治罪与治理并重的轻罪治理体系”。2024年7月,海城市人民检察院被辽宁省法学会刑法学研究会确定为法治实践基地,同时作为全省检察机关开展“轻罪治理,辽宁实践”试点院之一。现以海城市人民检察院轻罪检察实践为分析样本,通过对轻罪办理和治理方面取得的成效、面临的困惑进行调研分析,以期探索基层检察机关完善轻罪治理体系的有效路径。In recent years,the trend of misdemeanorization of criminal structure has become more and more obvious,and it is particularly urgent to build a misdemeanor governance system with Chinese characteristics.The supreme prosecutor in the procuratorial reform work plan clearly put forward"to promote the construction of crime and governance of misdemeanor governance system".In July,2024,the Liaoning Provincial Association of Law Criminal Law Research Society set Haicheng Procuratorate as the law governance practice base,as well as the pilot procuratorate in the action of"misdemeanor governance,Liaoning practice"carried out by procuratorial organs of Liaoning province.This research report takes Haicheng Procuratorate as the sample for analysis,through the research and analysis of the effectiveness achieved and the confusions faced in the handling and governance of misdemeanor crimes,with a view to explore the effective path to improving misdemeanor governance system in the grassroots procuratorate.
