摘 要:数据产权登记制度是数据基础制度体系中的关键性制度,但由于全国统一的数据产权登记制度尚未建立,数据产权登记的功能与模式、机构与客体、法定效力等均有待明确。数据产权登记应当发挥数据资产确权、可信交易、担保融资和数据监管等功能。然而,从各地出台的登记办法来看,数据产权登记的程序应用中存在各地登记启动条件、审查模式及审查要求不统一,决定程序的登记效力、不予登记的情形不明确等问题。基于此,文章认为,在审查程序上,应当采取“登记机关形式审查+第三方实质审查”模式,细化不同类型登记的审查要求;在决定程序中,应采取登记生效主义提升登记证书的公信效力,以及明确规定不予登记的具体情形,以便企业能规范申请登记。Data property registration system is the key part to the data infrastructure system,but due to the lack of a unified national system,its functions and models,institutions and objects,and legal validity are yet to be clarified.Data property registration system should play functions such as data asset ownership confirmation,trustworthy transactions,secured financing and data supervision.However,judging from the registration methods issued in various regions,there are problems such as inconsistencies among conditions for the initiation,examination procedures and requirements in different regions,the registration effectiveness of procedures,and the circumstances for non-registration are not clear.Based on this,the article believes that in the review process,a model of“formal review by the registration authority+substantive review by a third-party”should be adopted to refine the review requirements for different types of registrations;In the decision-making process,the registration effectiveness principle should be adopted to enhance the credibility of the certificate,as well as explicitly stipulate circumstances for non-registration,so that enterprises can apply for registration in a standardized manner.
