摘 要:人格标识商业化利用已成为实践常态。死者人格标识财产利益保护的理论基础为继承保护说,继承死者人格标识财产利益在我国具有规范基础,基于权能分离理论,继承人继承死者人格标识使用权。应明晰继承死者人格标识财产利益的保护主体、保护期限,规范死者人格标识商业化利用行为,协调公共利益与个人利益,防止死者人格标识被个人无期限商业化利用。The commercial use of personality markers has become a common practice.The theoretical basis for protecting the property interests of personality markers of the deceased is the theory of inheritance protection.Inheriting the property interests of personality markers of the deceased has a normative basis in China.Based on the theory of separation of powers,heirs inherit the right to use personality markers of the deceased.It is necessary to clarify the subject and order of inheriting the property interests of personality markers of the deceased,as well as the protection period.This thesis proposes the standardization of the commercial use of personality markers of the deceased,the coordination of public interests and personal interests,and the prevention of the indefinite commercial use of personality markers of the deceased by individuals.
