论空难中身亡机组成员之近亲属的精神损害赔偿——以某空难为例

摘　　要：因一次性工亡补助金与死亡赔偿金具有同质性,均属于财产损害赔偿,身亡机组成员之近亲属无法从工伤保险机构处获得精神损害赔偿。第三人原因导致空难的情形下,双重赔偿请求权系兼得关系,身亡机组成员之近亲属可向第三人请求精神损害赔偿。非第三人原因导致空难的情形下,应将双重赔偿请求权理解为替代关系,该类主体无法获得精神损害赔偿。基于我国现行工伤保险赔偿规则在某空难中暴露出的不公平问题,应当在工伤保险赔偿中增加精神损害赔偿项目,统一将双重赔偿请求权规定为替代关系并提高工伤保险赔偿数额。The one-time work-related death grant exhibits the same consistency as death compen-sation,which pertains to property damage compensation.Consequently,the close relatives of deed crew members cannot obtain mental damage compensation from the workers'compensation agency.In the event that an air crash is caused by a third party,the right to claim double compensation holds a concur-rent relationship.The close relatives of dead crew members may request compensation for mental dam-age.However,if an air crash is not caused by a third party,the right to claim double compensation should be construed as a substitution relationship and such subjects cannot obtain compensation for mental damage.Based on the current work-related injury insurance compensation regulations,the problem of unfair compensation exposed in this air crash is evident.Therefore,it is a necessity to add a mental damage compensation option to workers'compensation and uniformly specifying the right to claim double compensation as an alternative relationship and increasing workers'compensation.
