摘　　要：《民法典》第1169条第2款、第1189条、第1191条第2款、第1193条以及《交通事故解释》第16条规定的“相应的责任”,概括的是非典型共同侵权行为的混合责任。非典型共同侵权行为是多数人侵权行为之一种。主行为人实施的行为是主行为,其应当承担的侵权责任是连带责任,对全部损害承担赔偿责任,内部有其应承担的责任份额;从行为人实施的行为是从行为,其应当承担的相应责任是与其过错程度和行为原因力相适应的按份责任。被侵权人可以请求主行为人承担全部赔偿责任,但对从行为人只能请求承担按份责任。主行为人承担了全部赔偿责任后,对超出其应承担的责任份额之外的部分有权向从行为人追偿。从行为人先行赔付的,就超过自己按份责任份额的部分有权向主行为人追偿。The corresponding liability stipulated in Articles 1169(2),1189,1191(2),1193 of the Civil Code and the Article 16 of the Interpretation of Damages in Road Traffic Accidents summarizes the mixed liability for atypical joint torts.Atypical joint tort is a kind of majority tort.The main actor's behavior is the main behavior.He or she should bear joint and several liability for all the damages,and he or she has the internal share of responsibility.The behavior of the subordinate actor is the subordinate behavior.He or she should bear the corresponding responsibility,which is the share of responsibility appropriate with the degree of fault and the cause of the behavior.The infringee may request the main actor to assume full liability,but can only request the subordinate actor to assume share of liability.After the principal actor has assumed full liability,he or she has the right to recover from the subordinate actor the portion of the liability that exceeds his or her share of the liability.The subordinate actor pays first and has the right to recover from the principal actor for the part that exceeds his or her corresponding share.
