整体治理视角下贿赂犯罪的新解释

摘　　要：《刑法修正案(十二)》对行贿罪的修改是刑事政策刑法化的一种表现,它反映了贿赂犯罪治理全面转向“受贿行贿一起查”政策。“受贿行贿一起查”政策的推行没有否定“受贿侧重型”政策的历史功绩,而是对新时期贿赂犯罪内部结构和发生态势转变的适应性调整。“受贿行贿一起查”政策的实质是通过严惩行贿追求贿赂犯罪治理的整体利益,而这一整体利益取决于行贿与受贿的对合关系。在“受贿行贿一起查”政策框架下,要实现贿赂犯罪的整体治理效果,需要坚持区分对待,坚持行贿从属于受贿,严惩行贿最终是为了防范受贿泛滥。严惩行贿须用好特别从宽制度,这一制度不属于特别自首或立功制度,而属于特别坦白制度。新时期严惩行贿要注意防范重刑主义、刑讯逼供以及技术侦查措施的不当滥用,同时要重视对认罪认罚制度的适用,完善相关的配套机制,做到保障人权与惩治犯罪并重。The revision of offering bribes crimes in the Criminal Law Amendment(XII)is a manifestation of the criminalization of criminal policy,which reflects a comprehensive shift in the governance of bribery crimes towards the policy of"investigating bribe-offering together with bribe-taking".The implementation of the policy of"investigating bribe-offering together with bribe-taking"does not negate the historical merits of the"bribe-oriented"policy,but is an adaptive adjustment to the internal structure of the bribery crimes and the change of dynamics in the new era.The essence of the"investigating bribe-offering together with bribe-taking"policy is to pursue the holistic interests of bribery crimes governance by severely punishing offering bribes,which depends on the reciprocal relationship between offering and taking bribes.Within the"investigating bribe-offering together with bribetaking"framework,we need to insist on differentiated treatment and the subordination of offering bribes to taking bribes in order to achieve the holistic governance of bribery crimes.The strict punishment of offering bribes is ultimately to prevent the proliferation of the crime of taking bribes.Strict punishment of offering bribes needs to use the special leniency policy.The latter is not the special surrender or merit,but a special confession.In the new era of strict punishment of offering bribes,we should pay attention to the prevention of Severe-Penalty Doctrine,the torture to extort confessions and the improper abuse of technical investigative measures.Meanwhile,we also should pay attention to the application of the system of guilty pleas and penalties and improve the relevant supporting mechanisms,so as to place equal emphasis on the protection of human rights and punishment of the crimes.
