摘　　要：网络海外代购的兴起与飞速发展在为消费者带来巨大便利的同时,也不可避免地对消费者隐私权、知情权和安全保障权等权益造成侵害,构建行之有效的监管新格局成为回应现实监管需求的要务所在。我国已经搭建起网络海外代购领域的总体监管框架,但在网络海外代购消费者权益保护领域的监管上仍存在消费者隐私权、知情权等相关权益保障监管不完备、监管主体无法形成监督合力、智慧监管理念及方式适用局限、现有担保监管机制收效甚微和行业自律缺失等问题。在此情形下,需要坚持多元共治监管理念,制定更完备的法律规范以强化监管力度,完善消费者权益保证金、备付金制度,并在监管部门、网络海外代购服务平台及行业自律的合作监管趋势中顺时施宜,深化智慧监管理念及机制构造,以构建综合系统全面的监管体系。The rise and rapid development of the network overseas shopping for consumers bring great convenience,and inevitably to consumer privacy,the right to know,the right to safety and security and other rights and interests caused by the infringement.Constructing effective supervision of the new pattern has become a response to the reality of the regulatory needs of the important task.China has already set up a general regulatory framework for online overseas shopping.However,the regulation of consumer rights protection for online overseas shopping still exists in terms of consumer privacy,the right to know and other rights and interests of the consumer protection regulation,which is incomplete.The regulatory body cannot supervise the synergy;intelligent regulation and the limitations of the existing guarantee regulatory mechanism have little effect,and there is a lack of self-regulation and other issues.Under such circumstances,it is necessary to implement multi-dimensional co-regulation,formulate complete legal norms to strengthen supervision,improve the consumer rights and interests deposit and reserve fund system,and in the trend of cooperation and supervision among the supervisory authorities,online overseas purchasing service platforms and the industry’s self-regulation,deepen intelligent supervision and mechanism,to build an integrated systematic and comprehensive supervision system.
